End User License Agreement

This End User License Agreement (“EULA”) is a binding agreement between you and PBD covering your use of the Gather application. By creating an account, signing in, or otherwise using Gather, you accept this EULA together with the Terms of Service and Privacy Policy below. If you do not accept it, do not use Gather.

1. Licence and restrictions

PBD grants you a personal, revocable, non-exclusive, non-transferable licence to use Gather on Apple-branded devices you own or control, or in a supported web browser, in accordance with the Apple Media Services Terms and this EULA. You may not copy, modify, reverse engineer, sublicense, rent, resell, or redistribute the application, or use it in violation of any law.

2. Zero tolerance for objectionable content and abusive users

There is zero tolerance for objectionable content or abusive behaviour on Gather. As a condition of your licence, you agree that you will not create, upload, post, transmit, or share content, and will not behave in any way, that is:

  • Sexually explicit, pornographic, or otherwise obscene, including nudity and solicitation of sexual services
  • Harassing, bullying, threatening, hateful, defamatory, or targeted at a person or group based on race, ethnicity, national origin, religion, sex, gender, gender identity, sexual orientation, disability, or any other protected characteristic
  • Violent, or that promotes, glorifies, or incites violence, self-harm, suicide, or terrorism
  • Illegal, or that promotes illegal activity, including the sale of drugs, weapons, or stolen goods
  • Fraudulent, impersonating another person or entity, or otherwise deceptive, including fake profiles, spam, scams, and phishing
  • An invasion of privacy, including another person’s private information, photographs, or messages shared without consent
  • Infringing on anyone’s intellectual property or other rights

3. Content filtering

Gather automatically screens profile text — including names, biographies, previous roles, and interests — against a filter of prohibited terms, and rejects submissions that contain them. Filtering is automated and imperfect; it supplements, and does not replace, the reporting and blocking tools described below.

4. Reporting and blocking

Every profile in Discover and every conversation has a menu with Report and Block. Reporting sends the account to our moderation queue and hides it from your feed. Blocking removes the person from your Discover feed immediately, ends any match, deletes the conversation for both people, prevents any further contact, and notifies us so we can review the account. You can review and undo your blocks under Settings → Blocked accounts.

5. Our moderation commitment

We review every report and block within 24 hours. Where we find objectionable content or abusive behaviour, we remove the content and suspend or permanently terminate the account responsible, without refund and without prior notice. Serious cases may be referred to law enforcement. You may also reach us directly at hello@pbd.team.

6. Your responsibility for content

You are solely responsible for the content you submit and for your interactions with other users. You acknowledge that PBD is not liable for content provided by other users, and that Apple has no obligation whatsoever to furnish any maintenance or support services for Gather, or to investigate, defend, or resolve any claim relating to content you or another user submits. Apple and its subsidiaries are third-party beneficiaries of this EULA and may enforce its terms against you.

Terms of Service

Welcome to Gather (“Gather,” “we,” “us,” or “our”), a product of PBD. These Terms of Service (“Terms”) govern your access to and use of the Gather mobile and web applications, websites, and related services (collectively, the “Service”).

By creating an account or using Gather, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old to use Gather. The Service is intended for graduate business school classmates and related professional networking. You are responsible for providing accurate profile information and for all activity under your account.

2. Your account

You may sign in with Apple or Google. You must keep your credentials secure and notify us promptly of unauthorized use. We may suspend or terminate accounts that violate these Terms or that we reasonably believe create risk for other users or for Gather.

3. Acceptable use

The zero-tolerance policy in the EULA above applies in full. In addition, you agree not to:

  • Harass, threaten, stalk, or impersonate others
  • Post unlawful, discriminatory, sexually explicit, or otherwise harmful content
  • Scrape, reverse engineer, or interfere with the Service or other users’ data
  • Use Gather for spam, commercial solicitation without consent, or unsolicited advertising
  • Share another person’s private information without permission

4. Profiles & content

You retain ownership of content you submit (such as your name, photo, bio, and interests). You grant Gather a worldwide, non-exclusive, royalty-free license to host, display, and distribute that content as needed to operate the Service, including public share cards you choose to open via a share link.

You are solely responsible for your content and for interactions with other users. Gather does not conduct criminal background checks and does not guarantee the identity or conduct of users. Use Report or Block on any profile or conversation to flag content or cut off contact; we act on every report within 24 hours.

5. Matching & messaging

Discover, likes, matches, and chat are provided for networking among classmates. We may limit or rate-limit features to protect the Service. Matches and messages may be deleted when an account is closed.

6. Intellectual property

The Gather name, logos, design, and software are owned by PBD or its licensors. You may not copy, modify, or distribute them except as allowed by these Terms or with prior written consent.

7. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, secure, or error-free.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PBD AND ITS AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) USD $50.

9. Termination

You may delete your account in the app settings (or by contacting us). We may terminate or suspend access at any time for violation of these Terms or to protect users or the Service, including immediate and permanent removal of anyone who posts objectionable content or abuses another user. Provisions that by their nature should survive will survive termination.

10. Changes

We may update these Terms from time to time. We will post the updated version on this page and update the “Last updated” date. Continued use after changes become effective constitutes acceptance of the revised Terms.

Privacy Policy

This Privacy Policy explains how Gather (“Gather,” “we,” “us,” or “our”), operated by PBD, collects, uses, and shares information when you use the Service.

1. Information we collect

  • Account data: identifiers and profile details from Apple or Google sign-in (such as name and email), plus information you provide in onboarding and profile edit (photo, school, program, class year, school email, previous career, interests, optional age, bio, LinkedIn URL).
  • Usage data: swipes (like/pass), matches, messages you send, and basic product analytics needed to operate and improve Gather.
  • Safety data: reports you file and accounts you block, including the reason and any detail you add, retained so we can review the account and enforce our rules.
  • Device & logs: IP address, device type, app/browser version, and diagnostic logs from our hosting and auth providers.

2. How we use information

  • Create and maintain your account
  • Show you classmates and power Discover, Matches, and chat
  • Show public share cards when someone opens a share link you (or another user) distribute
  • Provide customer support and prevent abuse
  • Improve the Service and develop new features
  • Comply with law and enforce our Terms

3. How we share information

We share information with:

  • Other users: profile fields shown in Discover, Matches, chat, and public share pages (we do not put your internal user id in share URLs; public pages use an opaque link where available).
  • Service providers: infrastructure and auth partners (for example Supabase and Vercel) that process data on our behalf under contractual obligations.
  • Legal: when required by law, or to protect the rights, safety, or property of Gather, our users, or others.

We do not sell your personal information.

4. Retention

We keep account and messaging data while your account is active and for a reasonable period afterward for backups, dispute resolution, and legal compliance. You may request account deletion; we will delete or anonymize personal data except where we must retain it by law.

5. Security

We use industry-standard measures such as encrypted transport (HTTPS) and access controls. No method of transmission or storage is 100% secure; please use strong account protections with your Apple or Google provider.

6. Your choices & rights

You can edit profile fields in the app, control what you share publicly via share links, and delete your account. Depending on where you live, you may have rights to access, correct, delete, or export personal data, or to object to certain processing. Contact us to exercise these rights.

7. Children

Gather is not directed to children under 18. We do not knowingly collect personal information from children under 18.

8. International users

We may process and store information in the United States and other countries where our providers operate. By using the Service, you understand your information may be transferred to those locations.

9. Changes

We may update this Privacy Policy from time to time. We will post the updated version on this page and revise the “Last updated” date.
